Open to legal residents in ARIZONA, ARKANSAS, CALIFORNIA, COLORADO, IDAHO, IOWA, KANSAS, MICHIGAN, MINNESOTA, MISSOURI, MONTANA, NEBRASKA, NEVADA, NEW MEXICO, NORTH DAKOTA, OKLAHOMA, OREGON, SOUTH DAKOTA, UTAH, WASHINGTON OR WYOMING, who are 18 years of age or older as of the date of entry. PRIZE(S) MUST BE PICKED UP IN SALT LAKE COUNTY OR DAVIS COUNTY, UTAH.

The Sponsor of the Road Tripper Sweepstakes (hereinafter the “Sweepstakes”) is Maverik, Inc., a Utah corporation located at 185 S. State Street, Suite 800, Salt Lake City, UT 84111 (referred to hereinafter as either the “Company” or “Sponsor”). By participating, participants agree to these Official Rules, Maverik Adventure Club Terms and Conditions and the decision of the Sponsor, which are final and binding in all matter relating to the Sweepstakes.

  1. Sweepstakes Period: The Sweepstakes will begin at 12:01 AM Mountain Daylight Time (“MDT”) on July 3, 2024, and the Sweepstakes will end at 11:59 PM MDT on October 1, 2024 (“Sweepstakes Period”).

    Company may, in its sole discretion, cancel, terminate, modify or suspend the Sweepstakes if the Sweepstake is not capable of running as Company planned for any reason (including, but not limited to, due to tampering, unauthorized intervention, computer virus, fraud, technical or human error or any other causes which Company, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or intended conduct of this Sweepstakes).

  2. How to Enter: In order for a Participant to submit a valid Sweepstakes entry, Particiants may enter the Sweepstakes by any of the following four (4) ways:

    A. Adventure Club. By logging in to your Adventure Club account via maverik.com or through the Maverik mobile application, select “Use Points”, then “Win Stuff” and applying your Trail Points to the Sweepstakes. You will need to provide your e-mail address, legal name and residential address (as they appear on your driver’s license or other government identification), phone number, Maverik Adventure Club or Nitro ACH Card Number, e-mail notification options and accept the Terms & Conditions; or

    B. &Rewards. By logging in to your &Rewards account via Kumandgo.com, select “Redeem Points” and click the applicable sweepstakes to use the number of points you want to redeem for entries. You can also enter in the Kum & Go app by selecting the “Use Points” button at the bottom of the main page. You will need to provide your email address, legal name and residential address (as they appear on your driver’s license or other government identification), phone number, &Rewards Number, email notification options and accept the Terms & Conditions; or

    C. Online Entries. Open the form below and follow the instructions to complete and submit the registration from including a valid email address, full legal name, phone number, and age. The receipt of entry will be based on the delivery date of the completed form and must be received within the Sweepstakes Entry Period to be considered eligible to win. Each online entry shall be treated as the equivalent of twelve (12) Trail Point entries or twelve (12) &Rewards Point entries. No more than one (1) online entry may be submitted per person per day.

    D. Bonus Entries. By earning bonus entries from qualified purchases at Maverik or Kum & Go stores during the Sweepstake Period of qualified size Dr Pepper 20 oz (the “Qualified Products”). By purchasing Qualified Products with your Adventure Club, Nitro card, or &Rewards you will receive one (1) bonus entry per purchase of each Qualified Product purchase.

NO AUTOMATED ENTRIES: Auto entries prohibited. You must fill out your own entry form without the use of any automated sweepstakes entry filling services or form filling services. The use of any automated, programmed, robotic or similar system to enter is prohibited and will result in disqualification. Entries filled out by anyone other than you will be disqualified.

There is no limit to the number of earned Trail Points or &Rewards Points applied to the Sweepstakes during the Sweepstakes by registered participant and no limit to the number of Online Entries during the Sweepstakes, as defined herein. If the holder of an e-mail account from which an entry was sent is disputed, entry will be deemed made by the natural person who is assigned to the e-mail address by the internet access provider, online service provider or other organization (e.g., business, school, etc.) that assigns e-mail addresses for the domain associated with the e-mail address.

The Sponsor is not responsible for lost, late, illegible, damaged, incomplete, stolen, mutilated, postage-due, misdirected shipping or email; for for any errors or failures including those related to websites, computers, telecommunications, networks, Internet, equipment, software, services, transmissions, connections, processing, or any unauthorized access, tampering hacking, theft, or destruction. This includes technical or humon erros affecting the receipt or processing of entries, game piece requests or other submissions, or or related to production, promotion, administration, or execution of the Sweepstakes.

The Sponsor is not responsible for failed, partial, or garbled computer transmissions, service outages, technical failures (including, but not limited to, electronic malfunction or damage to any network, hardware or software), or any other causes beyond the Sponsor’s control that may corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes. If the Sweepstakes cannot proceed as planned due to causes including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other reasons beyond the Sponsor’s control, the Sponsor reserves the right to disqualify any tampering individuals and to cancel, terminate, modify, or suspend the Sweepstakes at its sole discretion.

The Sponsor assums no responsibility for any errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communications failures, theft, destruction, or unauthorized access to entries, or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any electronic entry to be received due to technical problems or traffic congestion on the Internet or at any website, or any combination thereof. This includes any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in or downloading materials from the Sweepstakes.

In case of a dispute regarding an entry, entry will be deemed made by the natural person who is assigned to the e-mail address by the internet access provider, online service provider or other organization (e.g., business, school, etc.) that assigns e-mail addresses for the domain associated with the e-mail address.

  1. Prize Details: There will be one (1) Grand Prize awarded pursuant to this Sweepstakes. The Grand Prize will consist of the following:

    A. one (1) 2023 Ford Bronco Sport (“Vehicle”),

    B. $5,000.00 cash, and

    C. up to $1,000.00 for travel and accomodations arranged and paid for by Sponsor (collectively, the “Grand Prize”).

The Approximate Retail Value (“ARV”) of the Grand Prize is approximately $57,377.00.

IN ORDER TO RECEIVE THE GRAND PRIZE, THE WINNER MUST SIGN AN OFFICIAL AFFIDAVIT AND RELEASE OF LIABILITY FORM PROVIDED BY THE COMPANY. NO PRIZE WARRANTY. WITHOUT LIMITING THE FOREGOING, ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

  1. Eligibility, and Limitations: All entries much be made within the Sweepstakes Period and received by 11:59 PM MDT October 1, 2024. Participants and winner(s) must be legal U.S. residents and at least the required age as determined by the Company on or before Sweeptsakes Start Date. Only one (1) prize per household will be allowed for the Sweepstakes. Employees of the Company, or its affiliates, the Sweepstakes participating sponsors and their advertising agencies, employees of radio or television stations advertising or promoting the Sweepstakes, and members of the immediate family of any such persons are not eligible to participate and win. The Executives of the Company, the Loyalty Administrator, and members of the immediate family of any such person are not eligible to participate and win.

    The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.

  2. Winner Selection: The Grand Prize winner will be selected in a random drawing to be held on or about November 5, 2024. Drawing will be conducted by Sponsor, whose decisions are final on all matters relating to the drawing. Sponsor will notify the Grand Prize winner by email or phone on or about five (5) business days following the applicable drawing date. If after three (3) attempts by email or phone during a forty-eight (48) hour time period (as determined by Company in its sole discretion) the Company is unable to contact the Grand Prize winner, the prize will be forfeited and an alternate winner will be selected by random drawing from all remaining eligible entries. Winner hereby accepts and agrees to these rules, acknowledges and affirms that they meet the Sweepstakes rules’ eligibility requirements, agrees to the publicity/liability set forth below, and agrees to sign and return to Company an Affidavit and Release in the form provided by Company no later than five (5) days after being notified that they are the potential winner, or the prize will be forfeited. An alternate winner for forfeited prizes may be selected at Company’s sole discretion.

    Grand Prize winner will be required to travel to Salt Lake County or Davis County, Utah, to take ownership of the Vehicle and attend the giveaway. As noted in Section 3 above, up to $1000 will be provided to the Grand Prize winner for travel and lodging accommodations in order to attend the giveaway, with the arrangements being made and paid for by Sponsor.

  3. Decisions. By participating in the Sweepstakes, participants agree to be bound by the decisions of Company personnel. Company reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or who Company believes has violated any rule, gained unfair advantage in participating in the Sweepstakes, or obtained winner status using fraudulent means. Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Sweepstakes and the Company’s decisions concerning such disputes shall be final. If the conduct or outcome of the Sweepstakes is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Company, Company reserves the right to terminate this Sweepstakes, or make such other decisions regarding the outcome as Company deems appropriate. All decisions will be made by Company and are final. Company may waive any of these rules in its sole discretion.

  4. Prize Odds: The estimated odds of winning the Grand Prize during the Sweepstakes Period will be dependent on the number of eligible entries received/postmarked during the Sweepstakes Period.

  5. Prize Restrictions: No cash redemptions. No transfer of Grand Prize permitted. No substitutions, except Sponsor may substitute a prize of equal or greater value at its sole discretion. All costs not specifically stated herein as being awarded are the sole responsibility of the Grand Prize winner.

  6. Taxes. Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Grand Prize winner is solely responsible for reporting and paying any and all applicable taxes related to the Grand Prize and paying any expenses associated with any prize that are not specifically provided for in the official rules. Grand Prize winner must provide the Company with valid identification, mailing address, and a valid taxpayer identification number or social security number on the form provided by Company before any prize will be awarded. Any person winning over six hundred dollars ($600.00) in prizes may receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

  7. Winner’s List: To obtain a list of the Grand Prize winner, one must mail a self-addressed stamped envelope to Winner’s List Address below. Mail must be received by the Winner’s List Request Deadline of no later than 12:00 PM MDT October 31, 2024. The Winner’s List will be sent once all prizes have been awarded. Winner’s List Request must be addressed to: Road Tripper Sweepstakes, ATTN: Winner’s List, Maverik, Inc., 185 S. State Street, Suite 800, Salt Lake City, UT 84111.

  8. Publicity; Use of Personal Information. By participating, all participants and winner(s) grant the Company exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other Sweepstakes and waive any claims to royalty, right, or remuneration for such use. By participating in the Sweepstakes, participants agree that the Company may disclose personal information obtained from participants in the Sweepstakes to third parties and use such information for marketing and other purposes.

  9. Compliance with Law. The conduct of the Sweepstakes is governed by the applicable laws of the Unites States of America and the local or state jurisdictions in which the Sweepstakes is eligible, which take precedence over any rule to the contrary herein. Company shall follow the applicable laws for conducting Sweepstakes, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, providing specific written information about the Sweepstakes, etc. as required by local and state law.

  10. Governing Law and Venue. The laws of the State of Utah, excluding the rules of conflicts of law, shall govern this and all matters arising out of or related to this Sweepstakes. The parties, including Sweepstakes winners, hereby submit to the exclusive jurisdiction of the state or federal courts located in Salt Lake County, Utah. Each party expressly agrees that it is subject to the jurisdiction and venue of those courts for purposes of such litigation. Each party hereby waives and covenants not to assert any claim that is not subject to personal jurisdiction in those courts or that venue in those courts is for any reason improper, inconvenient, prejudicial or otherwise inappropriate (including, without limitation, any claim under the judicial doctrine of forum non conveniens)

  11. Release of Liability. IN ORDER TO RECEIVE A PRIZE, WINNERS MUST SIGN AN OFFICIAL AFFIDAVIT AND RELEASE FORM PROVIDED BY THE COMPANY.

BY ENTERING OR PARTICIPATING IN THE SWEEPSTAKES, EACH ENTRANT, PARTICIPANT OR WINNER AGREE THAT IN NO EVENT WILL MAVERIK, INC., KUM & GO, L.C., SPONSORS, SWEEPSTAKES PARTIES, PRIZE PROVIDERS (INCLUDING BUT NOT LIMITED TO DR PEPPER/SEVEN UP, INC.) AND ALL THEIR RESPECTIVE DIRECTORS, OFFICERS, SHAREHOLDERS, OWNERS, AGENTS, AFFILIATES, SUBSIDIARIES, EMPLOYEES, OR ANY OTHER SPONSOR OR PROVIDER (COLLECTIVELY “RELEASEE(S)”) BE RESPONSIBLE OR LIABLE FOR, AND YOU HEREBY RELEASE THEM FROM, ANY AND ALL CLAIMS, ACTIONS, DAMAGES, LOSSES, COSTS, EXPENSE OR LIABILITY OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, PROPERTY DAMAGE, PERSONAL INJURIES AND/OR DEATH, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, AND COUNSEL FEES AND COURT COSTS) ARISING OR RESULTING FROM ANYTHING RELATING TO:

THE PRODUCTION, PROMOTION, ADMINISTRATION OR EXECUTION OF THE SWEEPSTAKES (OR YOUR PARTICIPATION IN IT); CANCELLATION, MODIFICATION OR RESCHEDULING OF ANY ASPECT OF THE SWEEPSTAKES; OF ANY WEB SITE(S) RELATED TO THE SWEEPSTAKES OR MATERIALS ON THE WEBSITE; ACCEPTANCE, POSSESSION, USE, MISUSE, OR NONUSE OF THE PRIZE; OR PARTICIPATING IN OR TRAVELING TO ANY SWEEPSTAKES-RELATED ACTIVITY.

CAUTION: ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON OR ENTITY TO THE FULLEST EXTENT PERMITTED BY LAW.

  1. Miscellaneous. Company may substitute prizes, amend the rules or discontinue the Sweepstakes at any time. Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Sweepstakes. Written copies of these rules are available by mail with written request with a stamped, self-addressed return envelope at the address indicated above, or may be read on this website http://www.maverik.com. All entries become the property of Company and will not be returned. Apple is not a sponsor of this Sweepstakes.
